Overdraft Privilege Policy


(Non-Sufficient Funds)

It is the policy of our Bank to comply with applicable laws and regulations, and to conduct business in accordance with applicable safety and soundness standards.

An insufficient balance may result from: A) The payment of checks, electronic funds transfers, or other withdrawal requests; B) Payments authorized by you; C) The return, unpaid, of items deposited by you; D) The imposition of bank service charges; or E) The deposit of items which according to the Bank's Fund Availability Policy, are treated as not yet "available" or finally paid.

We are not obligated to pay any item presented for payment if you account does not contain sufficient collected funds. However, if you maintain your account in good standing, defined as: A) Making regular monthly deposits; B) Bringing the account to a positive balance every thirty days or less; and C) There are no legal orders outstanding on your account; we will approve your reasonable overdrafts as a non-contractual courtesy. Generally, we will not approve an overdraft for you in excess of: $300 for personal checking accounts open more than thirty (30) days, or $500 for personal checking accounts open more than thirty (30) days and at least $600 in recurring deposits during the last statement cycle or $700 personal accounts open more than thirty (30) days and receiving regular recurring direct deposits. These limits include our Non-Sufficient Funds and/or Overdraft (NSF/OD) Charge(s). If we determine your account no longer meets any of the above conditions, the Overdraft Privilege on your account is subject to termination without notice.

We may refuse to pay an overdraft for you at any time, even though we may have previously paid overdrafts for you. You will be notified by mail of any non-sufficient funds items paid or returned that you may have; however we have no obligation to notify you before we pay or return any item. The amount of any overdrafts plus our Non-Sufficient Funds and/or Overdraft (NSF/OD) Charge(s) that you owe us shall be due and payable upon demand. If there is an overdraft paid by us on an account with more than one (1) owner on the signature card, each owner, and agent if applicable, drawing/presenting the item creating the overdraft, shall be jointly and severally liable for such overdrafts plus our Non-Sufficient Funds and/or Overdraft (NSF/OD) Charge(s).

LIMITATIONS: Available only to consumer accounts (excluding Money Market and Savings Accounts) for personal and household use and we will limit the number of accounts eligible for Overdraft Privilege to one account per household. Additionally, we reserve the right to not approve any overdrafts against your account until we can verify that your account is being maintained in good standing, as defined above.

ACCOUNT FEES: Whether we pay or return a Non-Sufficient Funds item, a flat per-item fee will be charged to your account as a Non-Sufficient Funds or Overdraft (NSF/OD) Charge, as set forth in our common fees schedule. Fees are not to exceed (5) per business day. We will decline to charge an overdraft fee for transactions of any amount that overdraw an account by less than $5.00 on personal consumer accounts.

An overdraft occurs when you do not have enough money in your account to cover a transaction, but we pay it anyway. We can cover your overdrafts in two different ways:

1. We have standard overdraft practices that come with your account.

2. We also offer Overdraft Protection plans, such as a link to a savings account and Overdraft Privilege™, which may be less expensive than our standard overdraft practices. To learn more about Overdraft Protection, please contact your branch location.

What are the standard overdraft practices that come with my account?

We do authorize and pay overdrafts for the following types of transactions:

• Checks and other transactions made using your checking account number;
• Automatic bill payments.

We do not authorize and pay overdrafts for the following types of transactions unless you ask us to (see below):

• ATM transactions
• Everyday debit card transactions

We pay overdrafts at our discretion, we do not guarantee that we will always authorize and pay any type of transaction.

If we do not authorize and pay an overdraft, your transaction will be declined.

What fees will I be charged if First International Bank pays my overdraft?

Under our standard overdraft practice, we will charge you a fee of up to $28* each time we pay an overdraft.

What if I want First International Bank to authorize and pay overdrafts on my ATM and everyday debit card transactions?
